Legal obligations of the municipality

Polish law imposes specific obligations on municipalities regarding ensuring residents' access to drinking water in crisis situations.

Crisis Management Act
Under the Act of 26 April 2007 on Crisis Management (Journal of Laws 2007 No. 89, item 590, as amended), the municipality is the fundamental unit of crisis management. The head of a rural commune, mayor, or city president is required to develop a municipal crisis management plan, which must include procedures for providing an emergency substitute supply of drinking water.
Act on Collective Water Supply and Collective Wastewater Disposal
The Act of 7 June 2001 places municipalities under an obligation to ensure residents' access to drinking water of adequate quality. In the event of a water-network failure, the municipality must provide an alternative source of drinking water for residents.
Liability of the executive body of the municipality
The head of a rural commune, mayor, or city president bears personal liability for the proper functioning of the crisis management system within the municipality. Inadequate preparation for a crisis situation may result in legal consequences and a loss of residents' trust.
